Florida's Wrongful Death Act allows the personal representative of the estate to bring a claim on behalf of the surviving spouse, children, parents and other dependents. The law is technical: who can recover, which damages are available and how the estate must be opened all follow specific rules and deadlines.

The personal representative of the estate files the case on behalf of the survivors. If there is no will naming one, the court appoints a representative, usually a close family member.
Generally two years from the date of death. Medical malpractice deaths have additional pre-suit requirements, so earlier is better.
Parents of adult children can recover for mental pain and suffering in many cases. A 2024 change expanded this for medical negligence deaths as well.
